Terms of sale (contractors)
These terms govern the business relationship between contractors and qcalculatrice.com, separate from the terms of use applicable to homeowners. By creating a contractor account, you accept them.
This translation is provided for convenience. In case of discrepancy, the French version prevails.
1. What you are buying
qcalculatrice.com gives access, for a fee, to requests from homeowners who have chosen to send their project to contractors in their area. Each lead contains the client's contact details, the building takeoff (dimensions, shape, targeted materials, declared condition) and the budget they have validated. From these elements, you decide whether the job interests you before opening the lead.
2. Eligibility
- You must hold a valid Régie du bâtiment du Québec (RBQ) licence for the categories of work concerned or, outside Quebec, the licence or registration required in your province, if any.
- The person creating the account must be of legal age and authorized to bind the business. The date and version of the terms accepted are recorded with the account.
- Your account remains pending verification until your licence has been validated. You can browse the available requests during this period, but not purchase access to them.
- We may refuse or suspend an account whose licence cannot be validated or whose use contravenes these terms.
3. Territories and trades
Your account is tied to one or more trades and areas (postal code prefixes). You only receive requests matching these territories and trades. You change your trades and territories yourself, from your workspace, at any time.
4. Pricing model: credits
- Access to leads is paid in credits. One credit is worth one Canadian dollar before taxes. You buy credits in tiers, whose price and number of credits are shown before purchase; credits are added to your account as soon as payment is confirmed.
- Each lead has a cost in credits, set by the project type and the estimated value of the work, shown before you open it. There is no subscription or recurring fee; unused credits stay in your account, with no expiry date.
- Credits are not refundable in cash, except if the service is discontinued (section 9) or where the law requires otherwise. They are personal to your account and cannot be transferred.
- Credit payments are processed by our payment processor (PayPal); we do not store your card data. An invoice in your company's name, bearing our GST and QST numbers, is available in your space for each purchase.
- A maximum of three contractors can open the same lead. Access is never exclusive.
- A promotion applies according to what is displayed at the relevant time: a launch discount on the cost of a lead is frozen when that lead is published; welcome credits are granted once per company (one RBQ licence, one account), when the account is activated; bonus credits on a tier are granted with the purchase. Free credits have the same use value as the others, are not convertible to cash and cannot be combined between accounts.
- During a launch free period, announced on the site, opening a file debits no credits; only files opened while the free period is displayed benefit from it. The free period is temporary: it ends when 200 contractor accounts have been activated, or earlier if we withdraw it, at any time and without notice. Files opened until then remain yours; files opened afterwards are paid in credits at the displayed cost; a file opened for free gives no right to a credit refund (section 6).
- The detailed terms of the launch free period and of the draw of 500 credits among the first 200 activated accounts (eligibility, draw date, nature of the prize) are set out in the launch promotion rules, which form part of these terms.
5. Taxes
Prices shown are before taxes. Applicable taxes (GST/QST) are added at the time of payment, in accordance with the registration numbers of 9423-8151 Québec inc. (GST 713673739RT0001, QST 1227757619TQ0001).
6. Non-compliant leads: reporting and credit returns
A lead reflects the answers given by the client and, where available, an automated measurement of their building. It is not a guarantee that the job matches the description exactly, nor that the client will hire you.
You can report a lead from your dashboard, within 7 days of opening it, for one of the following reasons only:
- Invalid contact details — The phone number AND the email do not work (number out of service, wrong recipient, email bounced).
- Client unreachable — No response after at least 3 attempts spread over 3 days, by phone and by email.
- The client says they requested nothing — You reached them: they say they never made a request on qcalculatrice.com.
- Address outside my territory — The exact address of the work is outside the areas you serve.
- Project unrelated to the lead — The client confirms a project of a different trade or nature than the one described.
The following are not grounds for a report:
- The client answers but does not call back, or is slow to decide.
- The client chose another contractor.
- The client changed their mind or postponed their project.
- The cost of the lead seems too high to you.
An accepted report returns the credits spent on that lead to your account — never a cash refund — and removes your access to the lead. We review every report and reply within two business days. When two contractors report the same lead for a reason that lies with the lead itself, the return is automatic for all its buyers and the lead is withdrawn.
Reporting is a remedy, not a right of return. If, over 90 days, more than 20% of the leads you opened are reported, each report is verified individually before any return; above 35%, online reporting is suspended and your account may be closed (section 9).
7. Your obligations
- Use purchased leads only to prepare a service offer for the client concerned.
- Not resell, publish or transfer a lead or the personal information it contains to a third party.
- Contact the client professionally and respect their decision if they decline to proceed.
8. Your obligations as a person in charge of personal information
The moment you open a lead, you in turn become responsible, within the meaning of Law 25, for the personal information it contains. You undertake to:
- use it only to prepare and follow up on a service offer for the project concerned;
- protect it with reasonable security measures;
- destroy it when it is no longer needed for that purpose;
- honour any request from the client to access, correct or withdraw their information, insofar as it concerns you.
9. Suspension and termination
We may suspend or close a contractor account for non-compliance with these terms, in particular reselling project files, repeated breaches of confidentiality obligations or abusive use of reporting (section 6). You may delete your account at any time, from the My Business page of your workspace; any remaining credits are lost and are not refunded in money.
If we discontinue the service, we will notify you by email at least 30 days in advance. Credits you purchased and had not spent on the discontinuation date are then refunded in cash, at the price paid, within 30 days. Free credits (welcome credits, tier bonuses) are not refundable.
10. Limitation of liability
To the extent permitted by law, 9423-8151 Québec inc. is not responsible for the outcome of a business relationship between you and a client, nor for decisions made on the basis of a purchased lead.
11. Changes to these terms
We may change these terms. Any change affecting the price of credits or project files, credit returns, reporting, your obligations or the discontinuation of the service is announced to you by e-mail, at your account address, at least 30 days before it takes effect. If you refuse it, you may close your account before that date: purchased, unspent credits are then refunded in money, at the price paid. Other changes (corrections, clarifications, new trades or territories) take effect on publication, the date at the top of this page being authoritative.
12. Governing law
These terms are governed by the laws applicable in the province of Quebec. Any dispute will be submitted to the competent courts of Quebec.
